Short answer
Legality depends on the state where you buy or receive the flower, not on a “near me” search or on a THCA label. Under federal law, hemp-derived THCA flower is legal when the finished product contains no more than 0.3% delta-9 THC on a dry-weight basis. That federal limit does not override state bans or state total-THC rules. If your state counts THCA as THC, a high-THCA flower can fail the state limit even when a lab report shows low delta-9 THC.
Check two things before you shop: your state's THC definition and the seller's batch-specific lab report. Local convenience does not change either one.
Why “near me” results mislead
Local listings show what shops stock, not what your state permits. A store can list THCA flower while a state agency treats the same product as marijuana. Same-day pickup and short delivery distances do not create legal cover. The product's status follows the statute where it is sold and where it is delivered.
THCA Flower vs THC Flower: Pick One, Then Compare the Rest
Sort your state into one of three buckets
- Delta-9-only hemp states: The state measures only delta-9 THC against a 0.3% dry-weight limit. High-THCA flower can pass if the delta-9 result is low.
- Total-THC states: The state counts THCA toward the THC limit. New York and Colorado, for example, use total-THC calculations that can capture THCA flower. A product that passes a delta-9-only test can fail here.
- Restrictive states: Some states ban intoxicating hemp cannabinoids or regulate THCA flower as marijuana. Sale, possession, and delivery can all be restricted.
Verify a local seller in five steps
- Open your state agriculture department's hemp page and find the state's THC definition.
- Search that page or the state statute for the terms “THCA” and “total THC.”
- Ask the shop for a batch-specific certificate of analysis from an accredited lab.
- Compare the report date and harvest date to the package you plan to buy.
- Confirm state delivery rules if you plan to order instead of visit.
What to check on the lab report
Look for delta-9 THC, THCA, and total THC. A report that lists only delta-9 THC does not answer a total-THC state's question. Check that the sample matches the batch or package code on the product. Reports without a batch identifier do not prove what is in the bag.
If your state restricts THCA flower
A shop across the state line or a mail-order package does not change your state's rule. Do not treat a delivery address in a permissive state as a workaround. If local listings disappear, the cause is often a state policy change or a enforcement action, not a supply shortage. Recheck the state rule before you travel or order.
